Biological Weapons Statute - Title 18, Chapter 10 of the U.S. Code

February 7, 2005 - Legislative Update - Amendment to the Biological Weapons Statute
Section 6906 of the Intelligence bill, S. 2845, which passed in December 2004, added provision 175c to the Biological Weapons Statute (Title 18, Chapter 10) making it a crime to “knowingly produce, engineer, synthesize, acquire, transfer, directly or indirectly, receive, possess, import, export, or use, or possess or threaten to use, variola virus…” There is an exception for conduct by or under the Secretary of Health and Human Services’ (HHS) authority. The definition defines variola virus as a “virus that can cause human smallpox or any derivative of the variola major virus that contains more than 85% of the gene sequence of the variola major virus or the variola minor virus.”
